Code of Civil Procedure, 1908–Order 7, Rule 11–Benami Transactions (Prohibition) Act, 1988–Sec. 4–Defendant nos. 5 & 6 are the subsequent purchasers of property–They cannot have any personal knowledge as to if the said properties in the hands of the original owners are joint hindu family property or are their individual properties or these have been acquired benami by the family members or are the properties possessed by the famale hindu in absolute sense–They are not right persons to move the application under Order 7, Rule 11.
