Representation of Peoples Act, 1950–Secs. 83(1)(a) & 123–Election petition with the ground of corrupt practice–Legal aspects–Election petition must contain a concise statement of material facts–The basic facts constituting corrupt practice must be pleaded in order to make the compliance of Sec. 83(1)(a)–Basic facts cannot be pleaded only by stating that the same find place in the documents relied upon–The first respondent-election petitioner merely stated that the contents of representation may be read as the part of election petition–This does not satisfy the requirement of incorporating a concise statement of material facts–Impunged order passed by the High Court, dismissing the application of the petitioner for rejection of election petition is liable to be set aside–Election petition stood dismissed.
