Hindu Marriage Act, 1955–Sec. 13–Decree of dissolution of marriage on the ground of desertion–Justification–Petition u/s. 9 filed by the respondent husband was dismissed with conclusion that the appellant had reasonable cause for not living with him as she was feared for her life–Trial Court passed the decree of divorce on the ground of 28 latters written by respondenthusband–All these were sent under U.P.C–Effect of collecting evidence–Further, all these were written within the period of eight months–These were written for showing the formality of efforts–Trial Court did not consider their contents–Plea of irretrievable break down of marriage also cannot be accepted in such circumstances–Impugned decree deserves to be set aside.
