Penal Code, 1860–Sec. 302/34–Conviction–Appreciation of–Death was caused due to gunshot injuries–Consistent version of eye-witnesses, eyewitnesses stated that all the accused’s fired on deceased–Recovery of only one bullet from the body of deceased cannot dilute the oral version of witnesses which was otherwise found reliable–All the witnesses were from the locality where the incident occurred–Test identification parade was not required because the appellants well known for the witnesses–No prejudice was caused to the appellant by not putting the FSL report before him in the statements u/s. 313–Held, the conviction was justified.
