Penal Code, 1860–Sec. 84–Code of Criminal Procedure, 1973–Sec. 329–When trial of a person who is suffering from unsoundness of mind, is proposed and the procedure of Sec. 329, Cr.P.C. is not applied, it would have to be held that the accused was not provided the opportunity to put up his defence as per law.
