Rajasthan Irrigation & Drainage Act, 1954–Sec. 23–Order as regards to sanctioning of water course–Appeal against–Dismissed–Executive Engineer issued the notice and asked for objections–When there was no objection and there was consent of the cultivator of murabba no. 327/386, water course was sanctioned–Water course has been operative since 28-07-2007 at the land of respondent no. 4 and the appeal has been preferred after ten years without explaining the delay–There is no transfer of existing water course at the land belonging to the petitioner’s father, therefore, the provisions of Sec. 23 are not applicable–Concurrent findings–Interference declined.
