Penal Code, 1860–Sec. 376–Code of Criminal Procedure, 1973–Sec. 482–Prayer for quashing the FIR with the contention that after registration of FIR, parties resolved their differences and eventually got married and living happy married life–Where the all-egation of rape has been made, the proceedings arising out of FIR cannot be quashed only because the prosecutrix and the accused have entered into a compromise and the victim’s family and the offender have settled the dispute–However, this Court cannot ignore and overlook the welfare and future of the prosecutrix–Result of criminal proceedings would indicate about the acquittal–Proceedings are liable to be quashed in view of peculiar facts and circumstances of case.
