Code of Civil Procedure, 1908–Sec. 11, Explanation IV–Res judicata–Applicability–Suit for possession led by the mother of parties, was decreed by appellate Court–Respondent P was not joined as a plaintiff in that suit–This fact cannot dispute his title to the suit property which had vested in him on
the death of his mother and it cannot be said that he had in any manner abandoned his title to the suit property–Plea raised as regard to res judicata is misplaced.
