Penal Code, 1860–Sec. 201–Conviction–Sustainability–Prosecution failed to prove that when the dead body was recovered, appellant was present in the village–No direct evidence in regard to conspiracy by appellant with the other accused–Merely because the appellant was arrested with the other accused N & S from the same house, it cannot be said that he disposed the body of deceased–He is entitled to be acquitted.
