Penal Code, 1860–Sec. 302–Evidence Act, 1872–Sec. 32–Conviction–Deceased stated in dying declaration that the appellant poured kerosene oil on her and set her ablaze–Dying declaration was recorded by Judicial Magistrate in the fit mental condition and her family members were sent out when it was recorded–No reason to disbelieve the dying declaration–Further, the statements of PW 5 & PW 6 are found corroborated with the case of prosecution–None of the neighbours were examined on behalf of appellant in view of his statements u/s. 313–No interference is required in the impugned
findings of conviction.
