Hindu Marriage Act, 1955–Sec. 13–Petition for dissolution of marriage on the ground of cruelty and desertion–Dismissed–Once the appellant admits to entering into compromise and resumption of conjugal relations with the respondent-wife, certainly, he voluntarily condoned the acts of cruelty of respondent-wife, if any prior to the date of resumption of his marital relations–The circumstances do not suggest to accept that appellant faced any mental cruelty from the wife on account of being bald, having dark complexion and suffering from lameness–Any ex-parte decision of Panchayat cannot be held binding upon the respondent–Case of the respondent-wife that the appellant himself evaded to take her to the matrimonial home, is found supported from the evidence of other witnesses–Appellant miserably failed to prove any cruelty by his wife post to the compromise in criminal case–Held, divorce petition was rightly rejected.
