Bharatiya Nagarik Suraksha Sanhita, 2023–Secs. 413 & 419(4) [Corresponding Secs. 372 & 378(4) of Cr.P.C.]–Negotiable Instruments Act, 1881–Sec. 138–Appeal against acquittal–If the complainant is not a victim of the offence, he would be required to prefer the leave application before the High Court for preferring the appeal against acquittal–However, if he is the victim of crime, he/she shall have right under the Proviso to Sec. 413, BNNS of prefer the appeal against acquittal, conviction for a lesser offence or imposing inadequate compensation–Appellant would be liberty to file an appeal before the concerned Sessions Judge within fifteen days from the date of this order.
