Penal Code, 1860–Sec. 302–Conviction–Proper Section–Appellant caused the death of his own wife by beating–The liver and spleen were pale because of loss of blood–All the injuries were caused by a blunt weapon–Cause of death was the cumulative effect of injuries–Blood of A group was found on the recovered clothes and stick–Same blood was found on the Ghaghra of deceased–Appellant failed to give any explanation regarding the
presence of A group blood–All the injuries were caused on the non-vital parts of the body–As per Investigation Officer, appellant was not agreed with the proposal of relation of her daughter–Possibility that the spouses might have quarreled on this issue–It can be inferred that he was not having the intention to cause the death, however, sufficient knowledge that the death might be caused by his act–Conviction deserves to be altered u/s. 304 Pt. II.
