Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 20–Acquittal–Reversed by the High Court–Justification–High Court proceeded to consider the evidence on record straightway without considering the reasons that had been weighed with the trial Court–Option or choice was not given to the accused before their personal search was undertaken–Though the personal search did not result into the recovery of any contraband, the non-compliance of affording the option was a reason which ways with the trial Court in disbelieving the case of prosecution–Impugned judgment passed by the High Court deserves to be set aside.
