Evidence Act, 1872–Sec. 65–Code of Criminal Procedure, 1973–Sec.91–Contradictory statements of complainant as regard to existence of agreement–Petitioner-accused can submit the copy of document and prove it as secondary evidence–If he is not having the copy of document, he can urge before the trial Court to impeach the credibility of the complainant and the trial Court shall appreciate the statements of complainant on the basis of his submission–Application u/s. 91 was rightly dismissed since the complainant had denied the possession of agreement.
