Code of Civil Procedure, 1908–Order 41, Rule 25–While dealing the appeal, RAA framed some new issues by discarding or substituting the existing issue and recorded the findings–Procedure adopted by him was not as per law–BOR rightly set aside the judgment of RAA, however, the matter was required to be remanded back to RAA to decide the appeal afresh without changing the issues–Both the orders set aside and direction issued accordingly.
