Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 8/20–Conviction– Appreciation of compliance of provisions of Sec. 50–Appellant was given the option to choose the search by Magistrate or Gazetted Officer–He opted to be searched by the seizure officer–Further the recovery was made from suitcase hence it was not necessary to comply with the provisions of Sec. 50–Two independent witnesses were present but they could not be examined by prosecution–This fact does not adversly affect the prosecution case–Prosecution established the case beyond the doubt–Held, conviction was justified–Declined to give any sympathy in fine in view of nature of offence.
