Rajasthan Tenancy Act, 1955–Sec. 16–Cancellation of allotment of land on the ground that the land was entered in revenue record as gair mumkin chhatriya and allotment was made illegally–Collector ignored the Circular dated 3.7.1971 and passed the order–Petitioner raised construction of a residential house after taking the permission from Gram Panchayat–Period of more then 40 years has been lapsed–Further, the order was passed in gross contravention of principle of natural justice–Map revealing that the road passes by separating the petitioner’s land and chatarian–Held, impugned orders passed by the Court’s below are liable to be set aside.
