Code of Criminal Procedure, 1973–Sec. 311–Negotiable Instruments Act, 1881–Sec. 138–Application u/s. 311 was allowed after the final arguments–Permissibility–Accused precluded ownself from examining u/s. 315 and exhibited the photocopy of bank statement along with the application u/s. 313(5)–Permission of Court was not obtained–Complainant was prevented from the cross-examination and rebut the document–Held, it cannot be said that the application was filed to fill the lacunae in the prosecution case–Further, the complainant had already prayed for the same effect on earlier occasion–Held, application was rightly allowed.
