Indian Easement Act, 1882–Secs. 52 & 53–Licence–Purview and scope –Licencer is not required to prove his ownership over the suit property–As per Ex. P 10, plaintiff-sangh was in possession of land more than 4.10 bigha and the houses of weavers were constructed over the excess land–Subsequently, the plaintiff-sangh got the patta of this land from Municipal Council–Merely because, the plaintiff was not having the ownership at the time of issuing the licence, it cannot be restrained to initiate the eviction proceedings–Concurrent findings of Courts below–Held, suit for possession was rightly decreed.
