Negotiable Instruments Act, 1881–Sec. 143-A–Direction to pay the 20% of Rs. 50,00,000/- –Sustainability –Trial Court has not considered the contention of appellant that the case of complainant was false and there was no corroboration of the fact that he paid the amount of Rs. 50,00,000/- as a loan transaction and that too by cash–Further contention that the cheque was issued by the appellant to the respondent’s father on account of other transaction by way of security–Trial Court ought to have exercised the direction judiciously–Impugned order set aside and application u/s. 143-A is dismissed.
