Motor Vehicles Act, 1988–Secs. 147(2) & 149–Liability of Insurance Company–Breach of conditions of policy–Driver was holding a licence to drive a light motor vehicle but before driving the light motor vehicle used as a commercial vehicle, no endorsement to drive commercial vehicle was obtained in the driving license–Held, Insurance Company cannot disown from its liability –It is the statutory right of the third party to recover the amount of compensation from Insurer–Insurer can proceed against the insured for recovery of the amount in the event there has been a violation of any condition of Insurance Policy.
