Penal Code, 1860–Sec. 306 [Corresponding Sec. 108 of BNS, 2023]–Conviction–Sustainability–Cause of death was asphyxia–Cross-marriages were solemnized between the families and dispute arose when the betrothal of brother of the deceased was discontinued by the family of the appellant–No allegation was made at the time of inquest proceedings–Even if, it is assumed that the deceased may have been scolded or rebuked for visiting her parental home against the wishes of her in-laws, such conduct, by itself, does not amount to “cruelty” or abetment”–No material on record to establish that the conduct of the appellant was such as would drive the deceased to a position to complete mental imbalance, compelling her to end her life–Conviction deserves to be set aside.
