Code of Civil Procedure, 1908–Order 22, Rule 4–Additional written statement was filed after impleadment of LR’s. of deceased-defendant–Trial Court ordered to keep it in D part of file as it was filed without leave of Court–Further, the subsequent application under Order 6, Rule 17 and Order 14,Rule 5 were hold infructuous–Appreciation–CPC does not visualize such manner of pleadings–If at all any thing is added to written statement, only the resort of Order 6, Rule 17 could have been taken–No illegality is found in the impugned order.
