Penal Code, 1860–Secs. 302 r/w. 149,143,148, 323 & 325–Conviction–Proper Section–Deceased was given beating–When she was given help by companions, accused D gave a knife stab–Appellant was unarmed–He pushed, slapped and boxed the deceased–Cycle chain and belt carried by other accused were not used–No evidence available to show that the appellant was having knowledge that the accused D was carrying a knife–Held, it cannot be held that the member of assembly was having the object for committing the murder–Held, conviction u/ss. 323, 325/149, 143 & 148 is justified.
