Permanent Injunction–Suit for–Partly decreed–In the sale deed executed in favour of the party from whom the defendant purchased the house no. 26, it was clearly mentioned that the purchaser would immediately close the ventilations/windows/projections existing in the common wall–She could not have conferred on the defendants better rights than her–Suit has been partly decreed on the basis of documentary evidence, therefore, the plea of the defendant that the plaintiff herself did not appear in evidence cannot be accepted–Further, in absence of any cloud over the title of the plaintiff qua the subject property, the suit for injunction was maintainable–No perversity, infirmity or jurisdictional error is found in the impugned judgment.
