Code of Criminal Procedure, 1973–Sec. 125 [Corresponding Sec. 144 of BNSS, 2023]–Maintenance of Rs. 8,000/- per month to petitioner-wife–Claim of enhancement–Acceptability–Family Court has demonstrably undertaken an assessent of the relevant factors, including the duration of marriage, the educational qualifications and capacity of the petitioner, the income and liabilities of the respondent and the overall factual matrix–Parties subsisted for an extremely short duration of about 57 days–Respondent has honoured the directions of the Family Court and has been regularly paying the maintenance amount instead of assailing the order or adopting dilatory tactics–The law does not envisage that because the husband earns more, the wife must necessarily receive half or a substantial fraction thereof–Petitioner is highly educated and professionally qualified individual–Impugned order reflects a reasoned exercise of judicial discretion–Interference declined.
