Industrial Disputes Act, 1947–Secs. 25F, 25G & 25H–Award passed by the Industrial Tribunal–Sustainability–Respondent-worked in different intervals in different branches of the petitioner-bank–Total period of adding the actual working, sundays and other holidays would come to 238 days which is less than 240 days–He failed to make out the case that he rendered continuous service of 240 days–He utterly failed to discharge his burden by proving that his service was more than 240 days in a calendar year–He was also required to prove that after his termination, ignoring his claim, any other workman was given preference and he was engaged–Tribunal committed error in passing the award.
