Rajasthan Tenancy Act, 1955–Sec. 251A–Rajasthan Colonisation (Genera Colony) Conditions, 1956–Condition 8(2)–Order of allowing the application–Sustainability–Provision stipulates that on being received such application, SDO has to hold the summary inquiry by inspecting the site himself or getting it inspected by an Officer not below the rank of Inspector–Though the application was filed by mentioning the wrong provision, but, the relief cannot be refused on this ground–However, the order was passed on the basis of certified Nazri Naksha issued by the Halka Patwari–Appellate and Revisional Authority also did not consider this aspect–Impugned order set aside with certain directions.
