Registration Act, 1908–Sec. 17(2)(v)–Compulsory registration of document–Require-ment–Trial Court decreed the suit with the view that the document Ex. P-6 was a memorandum of family settlement and it was not required to be registered–Facts of the case clearly establish that there was not only univocal family arrangement between the parties but it was even acted upon by the parties without any exception–First appellate Court adverted to the pleadings and oral and documentary evidence produced by the parties–Further, conclusion that the defendants failed to prove that they were in possession of the suit property or remained in possession thereof–Document was only a memorandum of family settlement and it was not required to be registered–Impugned judgment passed by High Court deserves to be set aside.
