Motor Vehicles Act, 1988–Secs. 155 & 166–Code of Civil Procedure, 1908–Order 1, Rule 10 r/w. Sec. 151–Death of owner of motor vehicle during the pendency of the claim proceedings–Tribunal abated the proceedings against owner as well as Insurance Company–Justification–Liability of Insurance Company would not come to end on account of death of the owner/ insured after the happening of the accident or failure of claimants to bring the LRs. of owner on record–Impugned abatement qua the Insurance Company deserves to be quashed and set aside.
