Rajasthan Court Fees & Suit Valuation Act, 1961–Sec. 24(e)/24A–Applicability of provision–Respondents sought to declare the sale deed null and void, executed by the LR’s. of K in favour of petitioner–They failed to produce any document regarding the ownership of the land in name of Dadu Sampraday–Earlier, K had sold some part of land and the sale deed was not challenged by anyone–Respondents wrongly filed the suit by invoking the provisions of Sec. 24(e)–Suit was to be filed by invoking the provisions of Sec. 24A–Findings of trial Court over this issue are not correct and these are liable to be set aside–Directed accordingly.
