Evidence Act, 1872–Sec. 114 r/w. 106–Applicability–Prosecution witnesses did not utter a single word to distinguish and identify the ornaments which they had seen the deceased wearing when leaving the house–Investigation Officer claimed to have recovered some of the ornaments at the instance of the accused which were actually worn by the deceased while
leaving the home–Prosecution can not bank upon the presumption as provided u/s. 114 r/w. 106 so as to operate the reverse burden requiring the accused to furnish an explanation for being in possession of the ornaments.
