Code of Criminal Procedure, 1973–Sec. 439–While granting the bail, High Court imposed the condition for removal of wall at the expenses of appellants and hand-over the possession of disputed property to the complainant–High Court exceeded its jurisdiction by imposing onerous and un-reasonable conditions unrelated to the grant of bail–The fundamental purpose of bail is to ensure the accused’s presence during the investigation and trial–Any condition imposed must be reasonable and directly related to this objective–Impugned condition is hereby set aside.
