Penal Code, 1860–Sec. 420–Charge-sheet for the offence–Allegation that the petitioner did not pay sale consideration for the purchase of four buffaloes–Specific allegation that the promise to pay the amount was to be fulfilled within seven days of delivery of cattles–Nothing to contradict the claim of delivery of cattles –Claim of the petitioner in regard to spot payment was not proved by the petitioner–If the buffaloes were remained unsold by the petitioner in the cattle fair, the possession thereof could be restored to the original owner–Promise made by the petitioner was with fraudulent and dishonest intention and to cause wrongful loss to the complainant–No case is made out for interference.
