Penal Code, 1860–Sec. 302/34–Conviction–Proper Section–Deceased sustained three head injuries, out of them one was caused by RR with the help of farsa–Remaining two injuries were caused by lathi–Contradiction in the testimony of witnesses in regard to the fact whether the appellant inflicted one or two lathi blows–Incident occurred on trifle issue of making cow dung cakes by mother of deceased–Common intention was to teach lession her and not to cause death–Cause of death was cumulative effect of three injuries –Held, conviction deserves to be altered u/s. 304 Pt. I.
