Penal Code, 1860–Secs. 376/511–Probation of Offenders Act, 1958–Sec. 4–Conviction–Proper section–Victim was not medically examined–FIR was lodged after four days without any satisfactory explanation–Witnesses have made contradictory statements in regard to the allegation–Held, appellant is acquitted from the charge u/s. 376/511 and is hereby convicted for the offence u/s. 354 IPC–The incident took place in the year 1992–Appellant has suffered in the matter for the last 30 years–No criminal antecedent of appellant or any kind of dispute between the parties–He is granted the benefit of Sec. 4 of P.O. Act.
