National Medical Commission Act, 2019–Sec. 34(2)–Penal Code, 1860–Secs. 417 & 420–FIR for the offence–Petitioner was found to be treating the patients without any authority–Even, he was not found distributing the medicines when the Investigation Officer went for investigation, it has no relevance–The mere fact that he displayed the title/words “Ayurveda Ratna’ with his name on a placard is enough to make a prima facie case–His registration certificate had been cancelled on 01.06.2010–However, he indulged in treating the patients–It amounts an act of cheating with patients and a jolt
to the system–No case is made out for quashing the FIR.
