Penal Code, 1860–Secs. 420, 120-B & 423–Cognizance for the offence–Complaint was filed against the officer & director of the company–No one was named–Thereafter petitioner was named by way of an application–No evidence available on record to show that the petitioner was involved in the offence–If the facts of the case are taken on their face value, no offence is made out u/ss. 420, 120-B & 423–Further, complainant has filed a claim before Consumer Forum and the amount has been paid in compliance of the order of Forum–Held, order of taking cognizance is liable to be quashed and set aside qua the petitioner.
