Evidence Act, 1872–Sec. 65–Application for taking the copy of notice as secondary evidence which was sent u/s. 106 T.P. Act–Allowed by trial Court–Appreciation of–Original notice will be with the defendant in view of acknowledgment receipt of the same, signed by him, placed by plaintiff on the record of trial Court–No prejudice would be caused to him by taking the copy of notice on record–He will be free to lead rebuttal evidence on the receipt of notice in issue–Held, no error is found in the impugned order of trial Court.
