Code of Criminal Procedure, 1973–Sec. 145–Scope–Proceedings u/s. 145 are of the nature of preventive nature and do not determine the rights of parties–Property can be attached for the purpose of maintaining the piece between the parties–If it is not clear that which of the parties is in possession, the fact of possession should be enquired and possession should be handed over to the party from which the possession was taken.
