Penal Code, 1860–Secs. 457, 380 & 201–Rajasthan Municipalities Act, 1959–Sec. 203–Prevention of Damage to Public Properties Act, 1984–Sec. 3–Cognizance for the offence–Sustainability–Police collected the documents in regard to ownership of land and found nothing to suggest the ownership in favour of the complainant-Municipality–Trial Court ignored these documents and proceeded on the basis of oral evidence of complainant–No sufficient ground to proceed after submitting the closure report–FIR is liable to be quashed.
