Code of Criminal Procedure, 1973–Sec. 228–Framing of charge–Legals aspects–At the stage of framing charge, the trial Court is not supposed to discuss in detail the evidence available on record–It has to frame prima facie opinion whether the material available on record give rise to grave suspicion against the accused that he has committed an offence for which charges can be framed on the basis of evidence collected by the prosecution–Defence cannot be considered at this stage.
