Code of Civil Procedure, 1908–Secs. 151 & Order 41, Rule 27–Prayer to take off the respondent’s additional affidavit from record–Rejection of–Respondent was to be given the liberty to lead evidence at least with respect to the documents which were taken on record by the trial Court pursuant to direction of the Appellate Court on her application filed under Order 41, Rule 27–Trial Court clarified that the affidavit shall be read only up to the extent of her ascertion about the additional documents filed at appellate stage–No infirmity or error of law or jurisdiction is found in the impugned order.
