Prevention of Corruption Act, 1988–Secs. 7, 12, 13(1)(D), 13(2) & 14–Cognizance for the offence–Sustainability –No evidence regarding demand and acceptance of bribe by the petitioner–In the closure report, it was stated that there was no demand in the conversations–Recovery of amount of Rs. 10 lakh from ‘A’ also has no foundation because the investigation officer had not collected any conversation of the petitioner that he had ever demanded the money–Diaries and papers recovered in the investigation cannot be read against the petitioner–Proceedings against the petitioner are liable to be quashed and set aside.
