Rajasthan Tenancy Act, 1955–Sec. 88–Suit for declaration of khatedari rights on the ground that the land in question was belonging to father-in-law of plaintiff but it was mortgaged with father of defendant–Decreed–Single Judge set aside the decree and dismissed the suit–Appreciation of–Issue as regard to limitation for filing the suit–This question was raised in written statement, however, it was not considered by any of authority–Single Judge considered this legal issue and found that the suit was barred by limitation–H obtained the khatedari rights in year 1959 where as the suit was instituted in year 1980–Father and grand-father of plaintiff did not raise any objection–Further, a suit for the same land was instituted by mother of plaintiff in year 1973 which was dismissed for non-prosecution–Held, Single Judge rightly held the suit barred by limitation.
