Penal Code, 1860–Secs. 420 & 406–FIR for the offence–Prayer for quashing–Admitted case that the petitioner received the loan by executing the agreement with the stipulation that in case of failure to repay the loan amount, the property mentioned in the agreement would be sold/transferred to the complainant–He issued two cheques for repayment of the loan which were dishonoured and, thereafter, he hustled in selling the property in question to other persons–Intention to cheat or deceive the complainant was since inception–No case is made out for any interference.
