Penal Code, 1860–Secs. 420, 406, 166, 167, 169, 175, 218, 197, 217, 216, 466, 467, 468, 469, & 471–FIR for the offence–Allegation that the pasture land was mutated in name of the plaintiff–Petitioner was working as S.D.O.–FIR deserves to be quashed on the following grounds-
Secs. 463 & 464–No allegation in FIR that any false document has been prepared or forgery has been committed in the revenue record.
Sec. 415–Complaint not disclosing who has been cheated to whom and who has taken wrongful gain out of cheating.
Sec. 166 & 167–No case is made out that any public servant has disobeyed any direction of law or framed any incorrect document or purchased and property as alleged in FIR Sec. 175–No allegation that any person disobeyed the order of public servant to produce any document.
Secs. 217 & 218–No allegation was found in FIR in regard to offence u/ss. 217 & 218.
FIR was lodged after the lapse of seven years and nothing was done to quash the impugned.
