Code of Criminal Procedure, 1973–Sec. 227–Order of discharge–Sus-tainability–Trial Court unnecessarily meticuously examined the evidence in favour of three accused as if it was holding final trial against them–Prima facie evidence was produced against them–Weapons of offence were recovered at the instance of all these accused and even accused SS was identified by the witness in the test identification parade–Prima facie case is existed against the accused–Impugned order is liable to be set aside–Trial Court is directed to proceed against them in accordance with law.
