Rajasthan Panchayati Raj Act, 1994–Sec. 38(4)–Suspension of petitioner-sarpanch on account of pendency of trial u/ss. 420, 466, 468 & 471–Case of forged mark-sheet of class VIII–Filing of charge-sheet by the police in the Court would serve the purpose of preliminary enquiry–After framing of charge, matter is required to be judicially scrutinized–Requirement of show cause notice or opportunity of hearing before passing the order of suspension would not be needed in such situation.
